01 Parties and Scope of Application
This agreement is entered into between you and HangZhou Caibo Network Technology Co., Ltd (hereinafter referred to as "we") regarding the use of the CollageX app, accompanying materials services, and this website. Please read this agreement and the Privacy Policy; please pay special attention to the clauses concerning your important rights and interests.
If you have questions about this agreement, you may use contact@caibo-inc.com to contact us. Minors should read and use the service under a guardian’s guidance; users without the required legal capacity must obtain their guardian’s consent.
02 Service Content and Conditions of Use
CollageX provides photo collage, image editing, template and material use, work management, and related creative functions. The specific capabilities, system requirements, and available materials are subject to the version you install and the actual interface; the descriptions and illustrative works on this website do not constitute a guarantee that all versions provide the same functions.
Some functions run locally on the device; services such as material downloads, app configuration, and feedback require a network. iCloud sync requires you to actively enable it and use an available Apple iCloud service. You should prepare compatible devices, network connections, and sufficient storage space yourself, and bear any network or storage fees that third parties may charge.
We grant you a non-exclusive, non-transferable license to use the app, provided you comply with this agreement. You should obtain the app through legitimate channels and must not sell, sublicense, or impersonate our services.
03 Your Content and Creative Rights
You retain the rights to photos, text, audio, and original works for which you hold lawful rights. Using CollageX to edit works does not automatically transfer these rights to us.
You should ensure that the content you import, edit, save, share, and submit has a lawful source, and that you have obtained the necessary copyright, portrait rights, privacy, and other authorizations. When using works for advertising, merchandise, or other commercial purposes, please verify the scope of authorization for each material, font, music, and person's likeness yourself.
Only to complete the upload, sync, feedback, or other processing you actively request, we may process the relevant content to the extent necessary to provide that function. This agreement does not grant us a blanket authorization to use your private photos as public materials, advertising, or AI training data.
04 Templates, Fonts, Music, and Third-Party Materials
The app, brand, interface design, code, and the templates and materials we provide are protected by intellectual property laws. Except for the usage licenses expressly granted, the relevant rights belong to us or their respective rights holders.
Assets may be subject to separate licenses, including requirements for personal use, commercial use, attribution, and prohibition of redistribution. Being downloadable or available in the app does not mean it may be used commercially at will, resold, or repackaged and redistributed. Please review the license terms accompanying assets, fonts, and music; if the scope of authorization is unclear, you should first verify with the rights holder or us.
Third-party fonts, filters, and brushes that you import yourself remain subject to their original licenses. We do not guarantee that all third-party formats, dynamic effects, or proprietary features can be fully reproduced.
05 Fair Use and Prohibited Conduct
You must not use the service to commit illegal acts or infringe upon the rights of others, including:
- Creating or disseminating illegal content, infringing intellectual property rights, portrait rights, or privacy rights, or impersonating others to commit fraud.
- Accessing systems without authorization, bypassing access controls, undermining request verification, spreading malicious code, or interfering with the normal operation of the service.
- Harming the service or the rights of other users through abusive automated requests, bulk scraping, or unreasonable traffic.
- Copying, reselling, or redistributing assets, fonts, or the app as a whole beyond the scope of use expressly permitted.
Software research, interoperability activities, and other statutory rights permitted by law shall not be improperly restricted by this agreement.
06 Fees and Third-Party Purchases
Whether fees are charged, purchasable items, prices, benefit periods, and applicable conditions are subject to the information clearly displayed in the app or on the official distribution platform before your purchase. This agreement does not indicate that subscription or paid features are currently offered.
If you purchase through a third-party platform such as Apple, payment, renewal management, cancellation, and refunds are also subject to that platform's rules and applicable law. Auto-renewal products should clearly state the renewal rules before purchase; you may manage them through the corresponding platform. We will not ask for your bank card password through this website.
07 Work Storage and Effect Limitations
Please properly back up important photos, projects, and resources. Uninstalling the app, device failure, insufficient storage, clearing resources, or changes to third-party cloud services may affect local or cloud content; deleting local data does not necessarily delete cloud copies at the same time.
Editing results are affected by source file quality, device performance, output size, format, and the selected effects. Enlarging cannot guarantee restoration of details that did not originally exist; automatic selection, retouching, beautification, or template layouts may require manual adjustment by you. Please check the final exported file before publishing, printing, or commercial delivery.
The app is not an identity verification, medical diagnosis, forensic identification, or other professional judgment tool, and the processing results should not be used as the sole basis for such judgments.
08 Personal Information and External Services
For details on how personal information is processed, see Privacy Policy. When using iCloud, system sharing, third-party file providers, or external websites, you should also understand the terms and privacy policies of the corresponding services.
External links are provided for convenience. Unless otherwise required by law or expressly promised by us, we do not control the content or continued availability of third-party services.
09 Updates, Service Changes, and Termination
To fix issues, improve compatibility, or meet legal requirements, we may update the app or adjust some services. When changes affecting users' important rights occur, we will provide reasonable notice or other necessary arrangements in accordance with law.
Due to maintenance, network failures, force majeure, or changes to third-party services, online features may be interrupted. We will take reasonable measures to maintain the service, but we do not promise that the service will operate without faults on any device, network, or time.
If you violate this agreement or engage in behavior that endangers service security, we may restrict the relevant online access to the necessary extent and handle the matter in accordance with law. You may stop using or uninstall the app; termination of use does not eliminate rights and obligations that have already arisen.
10 Scope of Liability and Statutory Rights
Each party shall bear its own liability in accordance with applicable law. If you cause damage due to your own violation of law, infringement, or use of content beyond the scope of authorization, you shall bear the corresponding liability in accordance with law.
To the extent permitted by law, we make no commitments beyond our statutory obligations for losses caused by network interruptions, third-party service failures, or your failure to properly back up data, which we cannot reasonably control. We will not exclude through this agreement any liability that may not be excluded under law, including damage caused by intent or gross negligence, as well as rights protected by applicable consumer protection laws.
11 Governing Law and Dispute Resolution
The formation, performance, and interpretation of this agreement shall be governed by the laws of the mainland region of the People's Republic of China, but this does not exclude consumer protection provisions in your location that may not be excluded by agreement under law.
If a dispute arises, we recommend contacting us first at contact@caibo-inc.com to seek an agreed resolution. If discussions do not resolve the dispute, either party may seek resolution in a people’s court with lawful jurisdiction. This clause does not limit your legal rights to complain, appeal, or pursue other remedies.
12 Agreement Changes and Contact
We will publish the latest agreement on this page and indicate the update date. Material changes will be notified as required by law, and consent will be obtained separately when required by law. If any individual provision is invalid under law, it does not affect the validity of the other valid provisions.
